You may be notified by the College that someone has made a written complaint against you or your practice. The College of Naturopaths of Ontario is required to accept any written complaint in writing and investigate any allegations of professional misconduct. Regardless of the seriousness of the complaint, the College is obligated to investigate and provide you with an opportunity to make written submissions to the Inquiries, Complaints and Reports Committee (“the ICRC”). Responding to a complaint to the College and ICRC submissions

Once you have received notice that a complaint was made against you to the College of Naturopaths of Ontario, you will receive a copy of the complaint and have an opportunity to make written submissions to the ICRC.

Written submissions to the ICRC are often your first chance to respond to a complaint made against you or about your practice. It is crucial to make a complete and timely response to the ICRC in order to defend your standing with the College. Depending on the outcome, the ICRC’s decision can have a significant impact on your reputation and ability to practice. If the ICRC issues a caution, orders that you take remedial programs, or if the ICRC refers your matter to the Discipline Committee, it will be posted on the College’s website and your public profile. An unfavourable ICRC decision can cause significant damage to your reputation and career. Responding to a Report of Investigation and ICRC submissions

Unlike a written complaint, you may not immediately receive notice that information has been provided about your practice or any allegations of professional misconduct. You may simply receive notice that an investigator has been appointed by the Registrar of the College of Naturopaths of Ontario and that your practice is being investigated. The College may take months to investigate your practice before you see any documents or receive any written report outlining the allegations made against you. Once you receive the Report of Investigation, you will have the opportunity to make submissions to the ICRC. Submissions to the ICRC responding to a report of investigation should be drafted by a lawyer who is experienced in dealing with the College of Naturopaths of Ontario and the ICRC.

Just like a written complaint, the ICRC must decide how to dispose of your matter, and what action, if any, should be taken against you. Decisions by the ICRC are often made public and posted on the College’s website, as well as your public profile. You should consult with a lawyer who can help protect your licence and professional reputation, and do everything possible to avoid an unfavourable decision from the ICRC or from having your matter referred to the Discipline Committee for a hearing.
